Employee Assistance Programme (EAP)

What is an EAP?
The Employee Assistance Programme (EAP) is essential for managing employees in line with the company’s Substance and Alcohol Management Policy (SAMP). Developed by TOX247 Ltd, the EAP ensures consistent formal decision-making protocols regarding an employee’s fitness for work at every stage. While some may see the EAP as a rehabilitation programme, it is, in fact, a workplace intervention aimed at making formal decisions about an employee’s future with the company.

-
Meets their legal obligation to be fit for work.
-
Is assessed for suitability to enter a substance management intervention, including a review of relevant GP treatment history if applicable.
-
Undergoes both wide and narrow window sample analysis to gauge the extent of substance misuse.
-
Is evaluated for unmet needs, with toxicology results used to address any integrity concerns (honesty or denial).
At this point, a decision is made to either enrol the employee in the EAP or exclude them, based on formal decision-making within Corporate Governance, considering all relevant legal, employment, and statutory factors. If enrolled, the employee will follow a treatment plan with one of four possible outcomes:
-
Phased return to work.
-
Full return to a different role (if treatment is ongoing).
-
Full return to the original role.
-
A decision of "not fit for purpose."
At TOX247, we view the EAP as a critical intervention to assess an employee’s ongoing fitness for work, ensuring the employer meets their fiduciary legal duty. We help employers navigate complex legal and insurance requirements and ensure their liability is protected when managing employees deemed unfit for work.
